Terms of Service

These Terms of Service govern your use of akuti.pt, and, if you're a restaurant client, your use of the digital menu services we build and manage for you (including menu.akuti.pt, your menu backoffice, and any template demo pages).
Who we are
Akuti is a brand of Overline Publicidade, a sole trader business, and is the entity that provides the digital services for restaurants described in these Terms, and the one you contract with — the services available are listed in the "Our services" section. Acceptance of these terms
By visiting this site, submitting our contact form, or using any service we provide as a client, you accept these terms. If you don't agree with them, please don't use our site or services. How we handle personal data collected through this site is described in our Privacy Policy.
Our services
As a client, the specific services we provide to you are agreed separately (for example, by email or a service agreement), and may include:
- Social media management
- Digital & interactive menu
- Multilingual menus
- Menu + QR code (PDF)
- Menu backoffice
- Google & TheFork review management
Client accounts and backoffice access
If we set you up with access to a menu backoffice, you're responsible for keeping your login credentials confidential and for all activity under your account. You're responsible for the accuracy of the content you enter or ask us to publish — dish names, descriptions, prices, availability, and photos — since this is served directly to your guests.
Your responsibilities
You agree to use our site and services lawfully, and not to misuse the platform — for example, by attempting to disrupt it, access other clients' data, or publish unlawful or infringing content through it.
Fees and billing
Fees for our services are set out in the service agreement or proposal you accept with us, and are billed accordingly. This site doesn't itself process payments or sell services directly.
Intellectual property
Akuti owns the platform, software, and designs we use to deliver our services, except where they incorporate your own branding or content. You retain ownership of your restaurant's brand, menu content, and photos that you provide to us. Photos and videos of dishes that we produce for you — including photography sessions and filming carried out by our team — are the property of Overline Publicidade. While you remain our client, we grant you a license to use this material in your menu, social media, and other marketing for your restaurant.
Service availability and changes
We work to keep our site and digital menus available and up to date, but we don't guarantee uninterrupted availability, and we may update, change, or discontinue features of our services over time.
Third-party services
Some of our services rely on third-party platforms — such as Instagram, Facebook, Google, and TheFork — that we don't control. We're not responsible for outages, policy changes, or content moderation decisions made by these third parties. The handling of personal data involved in third-party services is described in our Privacy Policy.
Limitation of liability
To the extent permitted by law, Akuti isn't liable for indirect or consequential losses arising from your use of our site or services. Nothing in these terms limits liability that can't be excluded under Portuguese law.
Termination
Either party may end a service relationship as agreed in the applicable service agreement. We may suspend or restrict access to the backoffice or our services if these terms are breached.
Governing law
These terms are governed by Portuguese law, and any dispute will be subject to the exclusive jurisdiction of the Portuguese courts.
Changes to these terms
We may update these terms from time to time. The date at the top of this page reflects the latest version.
